New York State Homes for Sale (NYSHFS) is an independent online real estate advertising and property discovery directory designed to give property owners, real estate professionals, and property managers a straightforward way to promote available properties throughout New York State.
NYSHFS is independently operated and is not owned, governed, or controlled by a REALTOR® association, real estate board, or traditional multiple listing service.
Independent Platform
NYSHFS operates under its own Terms of Service, Listing Rules, Advertising Standards, Fair Housing Policy, and other platform policies.
Participation does not require membership in a real estate board or association.
NYSHFS does not impose the rules, disciplinary procedures, cooperation requirements, or compensation structures of an external MLS board or real estate association.
Who May Use NYSHFS
Subject to NYSHFS policies and applicable law, the platform is designed for use by:
Property owners advertising property they own.
Licensed real estate professionals advertising property they are authorized to market.
Property managers and management companies authorized to advertise property on an owner’s behalf.
Other authorized property advertisers approved by NYSHFS.
Users remain responsible for maintaining any license, registration, professional qualification, ownership interest, or written authorization required by law for the activities they perform.
Property Advertising and Discovery
NYSHFS provides a centralized directory where authorized users may publish property information for public discovery.
Listings may include information such as property descriptions, photographs, pricing, location, features, availability, and contact information supplied by the advertiser.
NYSHFS provides the technology for displaying and discovering property advertisements. Advertisers remain responsible for the accuracy, legality, authorization, and integrity of the information they submit.
Property Owner Participation
Property owners may use NYSHFS to advertise their deeded property, subject to the platform’s Terms of Service and Listing Rules.
NYSHFS does not require an owner to become a member of a real estate board or association simply to advertise an eligible property through the directory.
Property owners remain responsible for complying with laws and disclosure requirements applicable to their property and transaction.
Real Estate Professionals
Real estate agents, brokers, property managers, and other professionals may advertise eligible properties when they possess the authority and professional licensing required for the activities they perform.
NYSHFS may request documentation establishing ownership, listing authority, professional licensing, or other authorization before or after a listing is published.
No Brokerage Representation
NYSHFS provides an advertising and property-discovery platform.
NYSHFS does not represent buyers, sellers, landlords, or tenants; negotiate purchase or lease terms; prepare transaction agreements; hold escrow funds; collect commissions; or act as a fiduciary for parties to a real estate transaction.
Users communicate and conduct transactions independently of NYSHFS and should obtain appropriate professional advice when necessary.
Compensation and Commissions
NYSHFS does not set, recommend, negotiate, collect, guarantee, or enforce real estate commissions or other transaction-based compensation.
Any compensation arrangements between real estate professionals, property owners, buyers, tenants, or other transaction participants are determined independently outside the NYSHFS platform and remain subject to applicable law and private agreements.
Subscriber and Advertiser Autonomy
Authorized advertisers retain control over the lawful content and terms of their property advertisements.
NYSHFS does not require cooperative compensation arrangements as a condition of participation.
Participation is not conditioned on membership in an external MLS, real estate association, or REALTOR® organization.
Listing Accuracy and Authorization
Every advertiser is responsible for ensuring that:
Property information is accurate and not misleading.
The advertiser owns the property or possesses appropriate authority to advertise it.
Photographs, descriptions, documents, and other uploaded content may lawfully be used.
Required professional licenses or authorizations are current.
Advertising complies with applicable fair housing, consumer protection, and real estate laws.
NYSHFS may request supporting documentation and may refuse, suspend, modify, or remove listings that violate platform policies or applicable law.
Fair Housing
NYSHFS supports equal access to housing opportunities.
Listings and use of the platform must comply with applicable federal, state, and local fair housing requirements. Discriminatory advertising or unlawful discriminatory use of the platform is prohibited.
Use of Listing Content
Property information submitted to NYSHFS may be displayed and distributed through the platform as permitted by the Terms of Service.
Unauthorized scraping, copying, republication, resale, or commercial redistribution of NYSHFS website content is prohibited to the extent permitted by applicable law.
Advertisers retain their rights in content they own while granting NYSHFS the permissions necessary to host, display, promote, and operate their listings as described in the Terms of Service.
